BETWEEN [landlord’s name], residing at [landlord’s address] (hereinafter referred to as the “Licensor”, which expression shall include their heirs, executors and assigns) of the ONE PART;

AND [tenant’s name], residing at [tenant’s address] (hereinafter referred to as the “Licensee”, which expression shall include their heirs, executors and assigns) of the OTHER PART.

NOW THIS AGREEMENT WITNESSETH as follows:

  1. Premises. The Licensor hereby grants to the Licensee leave and licence to occupy the residential premises situated at [property address], [city], [state] (hereinafter "the Premises"), together with the fixtures and fittings existing therein.
  2. Term. This agreement shall be for a period of 11 (Eleven) months commencing from [start date] and ending on [end date], unless terminated earlier in accordance with the terms herein. The parties may renew the agreement for a further term on mutually agreed terms.
  3. Rent. The Licensee shall pay a monthly rent of Rs. 0/- (Rupees Zero only), payable in advance on or before the 5th day of each calendar month, by bank transfer or such other mode as the parties may agree in writing.
  4. Security deposit. The Licensee has paid to the Licensor an interest-free refundable security deposit of Rs. 0/- (Rupees Zero only), the receipt of which the Licensor acknowledges. The deposit shall be refunded in full at the end of the term, after deducting any unpaid rent, unpaid utility charges, and the cost of making good any damage beyond normal wear and tear. An itemised written account of any deduction shall be given to the Licensee.
  5. Utilities. The Licensee shall pay for electricity, water, gas, internet and any other utilities consumed at the Premises during the term, as per the actual meter readings or the bills raised by the respective providers.
  6. Use of the premises. The Premises shall be used for residential purposes only. The Licensee shall not carry on any unlawful or hazardous activity at the Premises, and shall not sublet, assign or part with possession of the Premises or any part of it without the prior written consent of the Licensor.
  7. Maintenance and repairs. The Licensee shall keep the Premises in good and habitable condition and shall be responsible for minor day-to-day repairs. Major or structural repairs, and repairs to fittings that fail through ordinary use, shall be carried out by the Licensor at the Licensor’s cost within a reasonable time of being notified.
  8. Alterations. The Licensee shall not make any structural alteration or permanent addition to the Premises without the prior written consent of the Licensor.
  9. Right of entry. The Licensor or the Licensor’s authorised representative may enter the Premises to inspect it or carry out repairs, after giving the Licensee at least 24 hours’ prior notice, at a mutually convenient time, save in the case of an emergency.
  10. Termination. Either party may terminate this agreement before the expiry of the term by giving the other 1 (One) month prior notice in writing, or rent in lieu of such notice. On termination, the Licensee shall hand over vacant and peaceful possession of the Premises to the Licensor.
  11. Handover. At the end of the term the Licensee shall return the Premises in the same condition in which it was received, normal wear and tear excepted, together with all keys, fixtures and fittings, and shall clear all outstanding utility bills up to the date of handover.
  12. Governing law and jurisdiction. This agreement shall be governed by the laws of India, and the courts at [city], [state] shall have jurisdiction over any dispute arising out of it.

Before you sign

Print two copies. Both the landlord and the tenant sign each one, along with two witnesses, and each party keeps a signed original. You will need yours for HRA claims, police verification, address proof, and any later dispute over the deposit.

Get the agreement stamped as your state requires — stamp duty is a state subject and the amount varies, sometimes with the rent and deposit involved. A term of 12 months or more generally needs registration too, which is why the 11-month agreement became the Indian default.

Is this rent agreement legally valid?

The template covers the clauses a standard Indian residential tenancy needs, and a signed agreement between two consenting parties is a contract. But validity in a dispute usually turns on stamping and, above certain terms, registration — and those rules are set by each state. Get it stamped as your state requires, and have a lawyer review it if anything about your situation is unusual.

Why are most Indian rent agreements 11 months?

Under the Registration Act, a lease of 12 months or more generally must be registered, which brings registration charges and a trip to the sub-registrar. An 11-month term avoids that requirement, which is why it became the default. The agreement can simply be renewed at the end of each term.

Does a rent agreement need to be on stamp paper?

In most states yes — the agreement should be executed on stamp paper of the value your state prescribes, or e-stamped. The amount varies by state and sometimes by the rent and deposit involved. Print this agreement, then have it stamped according to your state’s rules before both parties sign.

Do I need a rent agreement to claim HRA?

Employers normally ask for rent receipts, and many ask for the rent agreement as supporting proof — especially if you pay rent to a relative. If your annual rent exceeds ₹1,00,000 your employer must also collect your landlord’s PAN. You can work out your exemption with the HRA calculator.
